The Ultimate Wedding Planner Terms and Conditions
By availing or accessing the Services, the User unequivocally consents to be legally bound by these Terms and our Privacy Policy, which are incorporated herein by way of reference. Should the User disagree with these Terms, the User should refrain from accessing or using the Services. The Terms supersede any previous agreements or Terms of Use between the User and us or any of our affiliates or predecessors.
We retain the exclusive discretion and right to change, modify, add or remove portions of these Terms at any time. The User agrees to abide by such modifications or revisions. The User acknowledges their responsibility to review the Terms periodically to discern any changes that have become effective. Continued use or accessing of the Services after such revisions become effective constitutes the User’s agreement to be bound by the revised Terms.
The User agrees to utilize The Ultimate Wedding Planner at their own risk. The Services, incorporating but not limited to, generated, displayed, or provided content via the Services, along with any products or services ordered or supplied through the Services, are provided on an "AS IS" and "AS AVAILABLE" basis. This implies that the Provider does not make any guarantees or warranties, express or implied, including warranties of fitness for a particular purpose, merchantability, and non-infringement.
The Provider does not guarantee that the Services will be available at any particular time nor meet any specific requirements or deliver specific results.
The Provider reserves the right to deny, suspend, or terminate the User's access to the Services, including any features or segments of the Services, and to remove and discard any content or materials submitted by the User to the Services at any time, for any reason, and without prior notice.
The Provider does not guarantee that the information on the Services will be accurate or up-to-date, that the Services or the information transmitted to or from the Services or stored on them will be secure from unauthorized access, that information and content stored by the User in their account or on the Services will remain retrievable and uncorrupted, or that the Services will be uninterrupted or error-free or free from viruses or other harmful components, or that any defects will be corrected.
In the event of any dissatisfaction with the Service, or any of the terms associated with it, the User's sole and exclusive remedy is to discontinue the use of the Service.
To gain access to specific features or areas of the Services, the User may need to register and establish an account. The User concurs to provide honest, accurate, up-to-date, and comprehensive information about themselves as stipulated by the relevant registration or log-in form, and the User is accountable for maintaining such information current, which includes contact information, to ensure effective communication. Certain features of the Services may only be accessible to registered Users. For access to such areas of the Services, the User will be required to log in with their username and password. The User bears responsibility for all activities that occur during the access of the Services through their account, irrespective of whether they have authorized such access. Hence, if the User creates an account, they should ensure the confidentiality of their account password. The Provider will not be liable for any loss or damage resulting from the User's failure to safeguard their password or account information.
In no event shall the Provider or any of the limited parties be liable for any direct, indirect, lost profits, special, incidental, or consequential damages, arising from or related directly or indirectly, to the use or inability to use the Services, for use of coupons, or for any decision made or action taken by the User in reliance on information contained on the Services. This applies regardless of if the action was brought for breach of contract, warranty, or tort, including negligence, and even if the essential purpose of any remedy fails to occur. In any circumstances, the liability of the Provider to the User or any third parties is capped at the lesser of the fees payed by the User to the Provider in the 12 months preceding the action giving rise to liability or $100.
The User hereby consents to absolve the Limited Parties from all claims, demands, and damages, both actual and consequential, of any kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, that arise out of or are in any way connected with any disputes between the User and any third parties or in any way associated with goods, services, or events involving third parties.
